PASSENGERS RIGHTS

Passenger rights according to Regulation (EU) no. 181/2011

Regulation (EU) no. 181/2011 (“Regulation”) on the rights of passengers in bus and coach transport, which entered into force on 1 March 2013, provides for a minimum set of rights for passengers travelling by bus within the European Union area, which, by way of non-exhaustive example, provide:

  • non-discriminatory terms and conditions
  • access to the transport without additional charges, for people with disabilities or reduced mobility, as well as compensation in the case of any damage or loss or their mobility equipment
  • minimum rules on passenger information before and during the journey, as well as general information on their rights
  • complaint systems, specially arranged by carriers and accessible to all passengers
  • independent national bodies in each Member State responsible for ensuring the application of the regulation and, if necessary, for imposing sanctions

As required by the Regulation, the competent authority to supervise the correct application of the same in Italy is the Transport Regulation Authority (“ART”), which can conduct monitoring and fact-finding investigations on the services as well as assess any passenger complaints.

ACCORDING TO ART. 25 OF REGULATION (EU) No. 181/2011, PASSENGERS MAY HAVE ACCESS TO COMPREHENSIBLE INFORMATIONS REGARDING THEIR RIGHTS UNDER THE MENTIONED REGULATION, THROUGH THIS SUMMARY ADOPTED BY THE EUROPEAN COMMISSION
